These terms cover:
- The Pulse apps on the Apple App Store
- omega.net.nz (including Pulse pages and demo bookings)
- Professional services we agree in writing (hosting, integration, training)
They do not replace the GNU AGPL-3.0 licence for Pulse source on GitHub. If you only clone and build from GitHub, AGPL is the licence that applies to that copy. Using our website or buying the App Store app is a separate matter.
Pulse is not affiliated with, endorsed by, or part of NetBox Labs or Zabbix SIA. Those names refer to software you may already run.
1. Two software distributions
GitHub (AGPL). Source is under AGPL-3.0 as in the repository LICENSE. You may run and modify that copy as AGPL allows. It is not the App Store binary and does not use App Store subscriptions.
App Store binary. The macOS, iOS, and iPadOS apps Omega offers on the App Store are a proprietary distribution, licensed under these terms and Apple’s Licensed Application End User License Agreement. Downloading that signed app does not give you AGPL rights in the binary. Source remains on GitHub under AGPL.
2. Eligibility
You must be able to enter a contract. If you use Pulse for an organisation, you confirm you have authority to bind it. The App Store app needs an Apple ID. You are responsible for the device and who uses that copy.
3. Licence to the App Store app
Omega grants you a personal, non-exclusive, non-transferable licence to use the App Store app on Apple-branded products you own or control, as Apple’s rules allow. You may not reverse engineer the signed binary except where the law cannot be waived, rent it out, or present it as your product.
NetBox, Zabbix, SSH, and Device Web need your servers and credentials, unless a services contract says Omega hosts them.
4. Device seats (App Store only)
Actions on billable devices require a seat:
- Free: 50 seated devices
- Growth: 250
- Pro: 1,500
- Unlimited: no device cap
Rack hardware the app treats as non-billable (panels, blanks, shelves) does not take a seat. Sync still stores what the server has. Unseated devices stay visible but are not actionable until you have a seat.
Growth, Pro, and Unlimited are auto-renewable subscriptions billed by Apple to your Apple ID at confirmation. They renew unless you turn off auto-renew at least 24 hours before the period ends. Manage or cancel: device Settings → Apple ID → Subscriptions. Restore Purchases is in the app. Family Sharing is off.
Apple’s terms govern payment, tax, refunds, and billing support. Omega does not take card numbers for IAP and does not issue IAP refunds.
Prices appear in your App Store storefront. Annual is meant as two months free versus twelve months of monthly, at Apple’s .99 points. NZD list: Growth 14.99 / 149.99, Pro 24.99 / 249.99, Unlimited 49.99 / 499.99 per month / year.
5. Acceptable use
Do not use Pulse to break the law, to reach systems you are not authorised to manage, or to abuse the App Store or our site. You must have authority for the tokens, keys, and hosts you configure.
SSH recording, if you enable it, is your record. You are responsible for notice to people on that system and for how long you keep files.
6. Your data on the device
Local inventory, events, recordings, and pins are yours (or your organisation’s). Omega does not claim them. You back up the device. We are not liable for your NetBox, Zabbix, or appliance outages.
7. Website and demos
The site is information and an invitation to talk. A demo booking is not a hosting contract. Quotes are valid only in writing.
The site uses Google Analytics (see the Privacy Policy). Do not submit production secrets through forms.
8. Omega Cloud and other services
If we host Pulse, NetBox, and/or Zabbix, that is Omega Cloud, currently in New Zealand only, under a services contract. That contract controls fees, service levels, export, and how long we keep tenant data after the engagement ends.
App Store subscriptions do not include Omega-operated servers. GitHub AGPL does not include our labour.
9. Open source notices
The App Store binary includes open-source components; notices are in the app and repository. AGPL duties attach to the GitHub distribution as that licence states.
10. Intellectual property
Pulse, the Omega name, and the app’s appearance are Omega’s. Do not use our marks to imply a partnership. You may say, factually, that Pulse can connect to your NetBox or Zabbix instance.
Feedback may be used to improve Pulse without paying you.
11. No warranty
The app and the website are provided as is. We do not warrant that Pulse is error-free, that sync always matches the server, or that it is fit for a particular operational or safety purpose. Do not treat it as the sole control system for life-safety without your own validation.
Where the New Zealand Consumer Guarantees Act 1993 applies and cannot be excluded (typically consumers), those guarantees remain. If you acquire Pulse in trade, you agree that Act does not apply to the extent the law allows.
12. Liability
To the maximum extent permitted by law, Omega is not liable for lost profits, lost data, or indirect loss, or for more than the fees you paid to Omega (not amounts paid to Apple) in the 12 months before the claim. This does not limit liability the law says cannot be limited, including for fraud.
Apple is not a party to these terms and is not responsible for Pulse or these terms, except as Apple’s EULA says.
13. Termination
You may delete the app at any time. Apple subscriptions continue until you cancel them with Apple. We may end the licence for material breach. Local data remains yours to export or erase.
14. Changes
We may update these terms by posting here and changing the effective date. Material changes to the app will follow Apple’s update rules where required.
15. Law
New Zealand law. New Zealand courts have exclusive jurisdiction, except that either party may seek urgent injunctive relief where it is needed.
